By accessing or using the Service, you signify that you have read, understood, and agree to be bound by this Terms of Use Agreement, whether or not you are a registered user of our Service. We reserve the right, at our discretion,to change, modify, add, or remove portions of these terms at any time and also to terminate the access to any or all MySafeTrip websites or its other sales channels and the related services or any portion thereof at any time, without notice, for general maintenance or any reason what so ever. Member Accounts

The user do not have to register in order to visit Mysafetrip.com. To access certain features of the Service, though, you will need to register with Mysafetrip.com and create a Member account. Your Member account gives you access to the services and functionality that we may establish and maintain from time to time and in our sole discretion. You may never use another Member’s account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify us immediately of any breach of security or unauthorized use of your account. Mysafetrip will not be liable for any losses caused by any unauthorized use of your account. Mysafetrip may send booking confirmation, itinerary information, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction, via SMS or by voice call on the contact number given by the User at the time of booking. We may also contact the User by voice call, SMS or email in case the User couldn’t or hasn’t concluded the booking, for any reason what so ever, to know the preference of the User for concluding the booking and also to help the User for the same. The User hereby unconditionally consents that such communications via SMS and/ or voice call by Mysafetrip is (a) upon the request and authorization of the User and is (b) ‘transactional’ and not an ‘unsolicited commercial communication’. By providing us your email address you consent to our using the email address to send you Service-related notices, including any notices required by law, in lieu of communication by postal mail. We may also use your email address to send you other messages, such as changes to features of the Service and special offers. If you do not want to receive such email messages, you may opt out. Opting out may prevent you from receiving email messages regarding updates, improvements, or offers.

Confidentiality

Any information which is specifically mentioned by Mysafetrip as Confidential shall be maintained confidentially by the user and shall not be disclosed unless as required by law or to serve the purpose of this agreement and the obligations of both the parties therein.

Service Rules

The user agrees not to engage in any of the following prohibited activities: (a) copying, distributing, or disclosing any part of the Service in any medium, including without limitation by any automated or non-automated scraping (b) using any automated system to access the Service in a manner that sends more request messages to the Mysafetrip servers than a human can reasonably produce in the same period of time by using a conventional on-line web browser (c)bypassing the measures we may use to prevent or restrict access to the Service, including without limitation features that prevent or restrict use or copying of any content or enforce limitations on use of the Service or the content therein (d) attempting to interfere with the proper working of the Service, compromise the system integrity or security or decipher any transmissions to or from the servers running the Service (e) taking any action that imposes, or may impose at our sole discretion an unreasonable or disproportionately large load on our infrastructure (f) uploading invalid data, viruses, worms, or other software agents through the Service (g) collecting or harvesting any personally identifiable information, including account names, from the Service (h) using the Service for any commercial solicitation purposes (i) impersonating another person or otherwise misrepresenting your affiliation with a person or entity, conducting fraud, hiding or attempting to hide your identity (j)accessing any content on the Service through any technology or means other than those provided or authorized by the Service or (k) transmitting spam, chain letters, or other unsolicited email.All aspects of the Service are subject to change or elimination at Mysafetrip's sole discretion.We may permanently or temporarily terminate, suspend, or otherwise refuse to permit your access to the Service without notice and liability for any reason, including if in Mysafetrip's sole determination you violate any provision of this Agreement, or for no reason. You agree that Mysafetrip will not be liable to you for any interruption of the Service, delay or failure to perform.

User Content

Some areas of the Service may allow Users to post content such as feedback, comments, questions, blog posts, travel information, videos, photographs, images, and other information ('User Content'). You are solely responsible for your User Content that you upload, publish, display, link to or otherwise make available on the Service, and you agree that we are only acting as a passive conduit for your online distribution and publication of your User Content. You understand that whether or not such User Content published, MySafeTrip does not guarantee any confidentiality with respect to any User Content. You agree not to post User Content that: (a) may create a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to you, to any other person, or to any animal (b) seeks to harm or exploit children by exposing them to inappropriate content, asking for personally identifiable details or otherwise (c) may constitute or contribute to a crime or tort (d) contains any information or content that we deem to be unlawful (including, without limitation, the disclosure of insider information under securities law or of another party’s trade secrets), harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, profane, or otherwise objectionable (e) contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships or (f) contains any information or content that you know is not correct and current. You agree that any User Content that you post does not and will not violate third-party rights of any kind, including without limitation any Intellectual Property Rights (as defined below), rights of publicity and privacy. MySafeTrip reserves the right, but is not obligated, to reject and/or remove any User Content that MySafeTrip believes, in its sole discretion, violates these provisions. For the purposes of this Agreement, “Intellectual Property Rights” means all patent rights, copyright rights, mask work rights, moral rights, rights of publicity, trademark, trade dress and service mark rights, goodwill, trade secret rights and other intellectual property rights as may now exist or hereafter come into existence, and all applications therefore and registrations, renewals and extensions thereof, under the laws of any state, country, territory or other jurisdiction. MySafeTrip takes no responsibility and assumes no liability for any User Content that you or any other User or third party posts or sends over the Service. You shall be solely responsible for your own User Content and the consequences of posting or publishing it. You understand and agree that any loss or damage of any kind that occurs as a result of the use of any User Content that you send, upload, download, stream, post, transmit, display, or otherwise make available or access through your use of the Service, is solely your responsibility. In connection with your User Content, you affirm, represent and warrant that (a)Your User Content and MySafeTrip's use thereof as contemplated by this Agreement and the Service will not infringe any rights of any third party, including but not limited to any Intellectual Property Rights, privacy rights and rights of publicity.(b)MySafeTrip may exercise the rights to your User Content granted under this Agreement without liability for payment of any guild fees, residuals, payments, fees, or royalties payable under any collective bargaining agreement or otherwise. (c)To the best of your knowledge, all your User Content and other information that you provide to us is truthful and accurate.(d)MySafeTrip is not responsible for any public display or misuse of your User Content. You understand and acknowledge that you may be exposed to User Content that is inaccurate, offensive, indecent, objectionable, or inappropriate for children, and you agree that MySafeTrip shall not be liable for any damages you allege to incur as a result of such User Content.

Force Majeure Circumstances

The user agrees that there can be exceptional circumstances where the service operators like the airlines, hotels, the respective transportation providers or concerns may be unable to honor the confirmed bookings due to various reasons like climatic conditions, labor unrest, insolvency, business exigencies, government decisions, operational and technical issues, route and flight cancellations etc. If MySafeTrip is informed in advance of such situations where dishonor of bookings may happen, we will make our best efforts to provide similar alternative to our customers or refund the booking amount after reasonable service charges, if supported and refunded by that respective service operators. The user agrees that MySafeTrip being an agent for facilitating the booking services shall not be responsible for any such circumstances and the customers have to contact that service provider directly for any further resolutions and refunds. The User agrees that in situations due to any technical or other failure in MySafeTrip, services committed earlier may not be provided or may involve substantial modification. In such cases, MySafeTrip shall refund the entire amount received from the customer for availing such services minus the applicable cancellation, refund or other charges, which shall completely discharge any and all liabilities of MySafeTrip against such non-provision of services or deficiencies. Additional liabilities, if any, shall be borne by the User. MySafeTrip shall not be liable for delays or inabilities in performance or nonperformance in whole or in part of its obligations due to any causes that are not due to its acts or omissions and are beyond its reasonable control, such as acts of God, fire, strikes, embargo, acts of government, acts of terrorism or other similar causes, problems at airlines, rails, buses, hotels or transporters end. In such event, the user affected will be promptly given notice as the situation permits. The maximum liability on part of MySafeTrip arising under any circumstances, in respect of any services offered on the site, shall be limited to the refund of total amount received from the customer for availing the services less any cancellation, refund or others charges, as may be applicable. In no case the liability shall include any loss, damage or additional expense whatsoever beyond the amount charged by MySafeTrip for its services.In no event shall MySafeTrip and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the MySafeTrip website(s) or any other channel . Neither shall MySafeTrip be responsible for the delay or inability to use the MySafeTrip websites or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the MySafeTrip website(s), or otherwise arising out of the use of the MySafeTrip website(s), whether based on contract, tort, negligence, strict liability or otherwise.MySafeTrip is not responsible for any errors, omissions or representations on any of its pages or on any links or on any of the linked website pages.

Safety Of Data Downloaded

The User understands and agrees that any material and/or data downloaded or otherwise obtained through the use of the Service is done entirely at their own discretion and risk and they will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material and/or data.Nevertheless, MySafeTrip will always make its best endeavors to ensure that the content on its websites or other information channels are free of any virus or such other malwares.

VISA obligations of the User

The travel bookings done by MySafeTrip are subject to the applicable requirements of Visa which are to be obtained by the individual traveller. MySafeTrip is not responsible for any issues, including inability to travel, arising out of such Visa requirements and is also not liable to refund for the untraveled bookings due to any such reason.

Indemnity

You agree to defend, indemnify and hold harmless MySafeTrip and its subsidiaries, agents, licensors, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service, including any data or content transmitted or received by you (b) your violation of any term of this Agreement (c) your violation of any third-party right, including without limitation any right of privacy, publicity rights or Intellectual Property Rights (d) any claim or damages that arise as a result of any of your User Content or any that is submitted via your account or (e) any other party’s access and use of the Service with your unique username, password or other appropriate security code.

Termination and Cancellation Policies

The User expressly undertakes to provide to MySafeTrip only correct and valid information while requesting for any services under this agreement, and not to make any misrepresentation of facts at all. Any default on part of the User would vitiate this agreement and shall disentitle the User from availing the services from MySafeTrip.In case MySafeTrip discovers or has reasons to believe at any time during or after receiving a request for services from the User that the request for services is either unauthorized or the information provided by the User or any of them is not correct or that any fact has been misrepresented by him, MySafeTrip in its sole discretion shall have the unrestricted right to take any steps against the User(s), including cancellation of the bookings, etc. without any prior intimation to the User. In such an event, MySafeTrip shall not be responsible or liable for any loss or damage that may be caused to the User or any of them as a consequence of such cancellation of booking or services.The User unequivocally indemnifies MySafeTrip of any such claim or liability and shall not hold MySafeTrip responsible for any loss or damage arising out of measures taken by MySafeTrip for safeguarding its own interest and that of its genuine customers. This would also include MySafeTrip denying/cancelling any bookings on account of suspected fraud transactions.

Severability

If any provision of this agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect.

Disclaimer & Limitation of Liability

The User expressly agrees that use of the services is at their sole risk. To the extent MySafeTrip acts only as a booking agent on behalf of third party service providers, it shall not have any liability whatsoever for any aspect of the standards of services provided by the service providers. In no circumstances shall MySafeTrip be liable for the services provided by the service provider.EVERYTHING ON THE SITES, INCLUDING ANY PRODUCTS OR SERVICES OFFERED FOR SALE, IS PROVIDED "AS IS" AND " AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. MySafeTrip makes no warranties or representations regarding the information or content contained on the site, and specifically disclaims any warranty as to the suitability, reliability, timeliness or accuracy of the information contained on the site for any purpose. MySafeTrip does not warrant that the functions contained in the content will be uninterrupted or error-free, that defects will be corrected, or that the sites or the server that makes such content available are free of viruses or other harmful components. MySafeTrip does not warrant or make any representations regarding the use or the results of the use of the contents in the sites in terms of their correctness, accuracy or reliability.MySafeTrip may change the features or functionality of the services at any time, in their sole discretion, without notice. If the User does not agree with any of the terms above, they are advised not to read the material on any of the MySafeTrip pages or otherwise use any of the contents, pages, information or any other material provided by MySafeTrip.The sole and exclusive remedy of the User in case of disagreement, in whole or in part, of the user agreement, is to discontinue using the services after notifying MySafeTrip in writing.
